THE RULES OF
1. OBJECTIVES AND GOVERNANCE
1.1 The Club shall be called the WIGAN SWIMMING, WATER POLO and LIFE-SAVING
CLUB.
It’s OBJECTIVES shall be to teach and encourage swimming and life saving and
promote competition among its members. All competition shall be under A.S.A.
laws.
1.2 The club is affiliated to the Bolton and District Swimming and Water
Polo Association and The Central Lancashire Swimming
and Water Polo Association as well as The Northern Counties A.S.A. It shall
adopt and conform to the rules of these associations and will conduct its
affairs and business at all times in accordance with the laws of the Amateur
Swimming Association (“A.S.A. Laws”) as far as is practicable.
1.3 The Club shall be governed by a Committee comprising of the elected
officers of Chairperson, Honorary Secretary, Honorary Treasurer, Head Coach,
Honorary Competition Secretary, and a minimum of six other members. Four
members including two elected officers will form a quorum. The Committee
shall have power to co-opt any member interested in swimming without the
power to vote. All voting members must pay a minimal £1 annual membership
fee.
1.4 Funds or other assets of the Club shall be used towards the furtherance
of the Clubs objectives or for any charitable purpose. In the event of
dissolution the funds and other assets remaining will be distributed equally
among its existing members at the time to the maximum of one years
membership fees per member. Any remaining assets will be distributed to a
charity or swimming cause by the retiring committee.
1.5 The Committee at their annual general meeting shall appoint a
Chairperson, other elected officers described above, two trustees and an
auditor. They shall also appoint a Selection Committee consisting of a
minimum three persons to assist the Head Coach in the selection of all
swimming teams. The Head Coach will be expected to exercise a role in team
selection.
1.6 The Committee shall deal with all matters in connection with the Local
and Regional Sports development bodies and will nominate a representative to
those bodies.
1.7 If any Wigan Swimming Club member has any concern regarding Child
Protection they should contact and member of the
Wigan Swimming Club Committee immediately.
Any queries and concerns regarding Child Protection will be handled in
strictest confidence.
2. MEMBERSHIP AND COMPETITION
2.1 The Club undertakes to provide efficient instruction in swimming. All
swimmers are expected to place their services at the disposal of the Club.
Any swimmer failing to turn up for Club events when selected may be expelled
or prohibited from taking part in Club Championships and Galas, subject to
disciplinary procedures laid down in A.S.A. law.
2.2 Club practice sessions shall be held at Wigan International Pool except
for Friday sessions which will be held at the Nye Bevan Pool in Skelmersdale
(subject to Wigan and West Lancs council approval as appropriate) at the
following times:
Wednesday 6.00pm - 9.30pm,
Sunday 11.00am - 2.30pm
Monday 7.00pm – 9.30pm.
Friday 8.00pm – 9.00pm (subject to no gala competition and a small fee per
session).
Sessions are open to all members (groups 1 to 4 inclusive) at published
times on the clubs notice boards. Trials for entry in the Club shall take
place at 11.00am to 2.30pm on Sundays or 6pm to 9.30 p.m. on Wednesdays.
(Times may vary so please consult the notice board or a Committee member).
All swimmers must arrive at the poolside in time for the commencement of the
practice session. Appropriate swimwear should be worn that is in accordance
with the relevant Local Authority guidelines or rules. Swimmers should
attend practice sessions prepared to train and shall conduct themselves in a
reasonable manner at all times when under the supervision of Club trainers.
2.3 Swimmers approaching the club shall be allowed four free swims during a
maximum period of two weeks as a trial period. Swimmers will then be
expected to decide whether to join the club paying the appropriate
membership fee. The membership fee will normally be reviewed at the club’s
AGM and set for the following year. Annual membership fees become due and
payable on 1st January each year.
The fees for the current year are set out in appendix 1.
2.4 Any swimmer joining Wigan Swimming Club after the AGM but before January
1st will be allowed to swim for the remaining
period of that year and the whole of the following year paying only the fees
set at the Annual General Meeting for the following year.
2.5 Wigan Swimming Club recognises that individual circumstances may prevent
swimmers (or potential swimmers) from enjoying the full benefits of club
membership. Designated Committee Officers (including The Chairman,
Secretary, Treasurer and Head Coach or two thereof) can consider
representation on behalf of individual members or potential members
(including parents or guardians) along with proof of those circumstances.
The Clubs representatives shall be able to waive part or all of the
membership fees for a maximum period of 12 months after which the
circumstances must be reconsidered. Alternatively The Clubs representatives
may provide other assistance within the clubs means as they see fit up to a
maximum value equivalent to one years current fees without referral to the
full committee. All decisions shall be reported to the next full committee
for ratification.
2.6 Entry to Club Championships and Annual Gala shall only be accepted from
:
Members joining before October 1st of that year whose principal club is
Wigan Swimming Club.
Members joining before August 1st of that year who are also members of other
clubs who are fully committed to Wigan Swimming Club Competitive programme
2.7 All Trophies will remain the property of the Club at all times and shall
be held by the successful competitors and teams for a period of 11 (eleven)
months subject to giving a receipt to the Hon. Secretary and a guarantee for
their custody. The trophies shall be returned to the club within 14
(fourteen) days after receipt of notification asking for their return.
2.8 Any swimmer wishing to compete competitively for Wigan Swimming Club
must attend a Time Trial annually, or agree to submit appropriate verifiable
times or alternatively be timed at the discretion and the convenience of the
coaching staff or selection committee.Any swimmer selected to represent
Wigan Swimming Club shall make all reasonable efforts to wear club swimwear
(including caps if worn) and club tops or track suits during the period of
the competition.
2.9 Membership fees will not normally be refunded under any circumstances.
However in exceptional and proven cases the Committee can consider an appeal
against a decision not to refund fees and/or other expenses incurred.
3. COMMITTEE AND POWERS
3.1 The Committee shall meet on the third Thursday in every month. The Hon.
Treasurer to present a monthly financial statement to the Committee.
3.2 The Committee shall have the power to call an Extra-Ordinary General
Meeting at any time or upon written request of six elected members. Only
business stated on the agenda shall be dwelt with.
3.3 Any member of the Committee not attending three meetings in any twelve
month period shall be deemed to have resignedbut shall be notified in
writing by authority of the Committee and given an opportunity of appearing
before them to explain the reason for such absence. If the Committee are
satisfied with the explanation then a further period of services will be
considered. Members wishing to resign should do so in writing to the Club
Secretary giving appropriate notice.
3.4 Twenty-eight days notice of the AGM, to be held in November, shall be
given to members. All nominations for office and proposals for alterations
to Rules shall be in Hon. Secretary’s hands not later the September 30th.
3.5 At the discretion of the Committee suitable awards will be made to any
member of the Club instrumental in saving life from drowning, or for
outstanding achievement representing the club or country in swimming or
water polo.
3.6 The Committee may delegate responsibility for specific matters to
individual members at its discretion.
3.7 All complaints to be handed to the Hon. Secretary in writing within the
time scale laid down in A.S.A. law and to be considered by the committee at
the following full meeting.
3.8 The Committee shall be able to pay, refund or reasonably award Officers,
Members or Coaches for services rendered or costs incurred on behalf of, or
for the benefit of, the club or its members.
3.9 The Committee shall have power to prohibit any member taking part in the
Club’s Competitions if their subscriptions are one month or more in arrears.
4. CODE OF CONDUCT AND CHANGES
4.1 Any member joining the club agrees to abide by the clubs code of conduct
for behaviour at training and in competition as set out in appendix 2.
4.2 For breach of its own Club rules, for misconduct or for the infringement
of Local Authority rules or guidelines the Committee has the power to expel
any member proved guilty of such acts. Such decisions will be as far as
practicable subject to A.S.A. Laws 134 and129/130, or if in its opinion it
would not be in the interests of the club for that person to remain a
member.
4.3 Nominated Officers of the club may temporarily exclude or suspend a club
member from training or practice sessions if in their opinion such action is
in the interest of the club. Where such action is taken the matter shall be
subsequently considered and dealt with in accordance with the clubs rules.
4.4 Anyone resigning from the Club must return all Club properties before
the resignation can be accepted.
4.5 No alteration to these Rules shall be allowed unless approved by a
majority of those present and voting at the AGM or a special general meeting
called for such purpose.
4.6 The Committee shall have the power to deal with all matters not provided
for in the foregoing rules.
